Limitation of liability:

Econnect Holidays Services Pvt. Ltd. accepts liability for those arrangements for your holiday/tour, which are wholly within its control and therefore, accepts liability to clients for the negligence of its agents, which include its employees. However, the company would like to draw your attention to the following circumstances, which fall outside its direct control or where for some reason company is not prepared to accept liability. The Company shall, in no circumstances whatsoever be liable to the client or any person traveling with him or her for: Any death, personal injury, sickness, accident, loss delay, discomfort, increased expenses, consequential loss and/or damage or theft howsoever caused; Any act, omission, the default of any independent contractor or other person or by any servant or agents employed by the company who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the client or for any person traveling with him howsoever caused. Econnect Holidays Services Pvt. Ltd. is unable to take liability for commercial arrangements being out of its control such as natural disasters, industrial disputes, reason of threats or war, lockdowns, riots, civil strife, terrorist activities, technical problems to transport, extreme weather conditions, closure of the airports and sea ports and similar event out of our control, or are due to unusual and unforeseeable circumstances beyond your control.

The company does not own or control hotels, coaches, or other facilities mentioned in the tour. As an operator of the package tour, therefore, we cannot be held liable.

5.1, Where there has been no fault on the part of the company, supplier, or agents.

5.2, Where the failures in performance of the contract are attributable to the customer.

5.3, Where the failures are attributable to a third party not connected with the provision of the holiday/tour and are unforeseeable or unavoidable.

5.4, Where the failures are due to unusual and unforeseeable circumstances beyond control.

5.5, Where the failures are due to an event which you or your supplier even with all due care could not foresee or foretell.

5.6,) in case of any force majeure conditions.

However, the Company makes all reasonable steps in ensuring the services match the industry standards. The information provided to the customer has been compiled with all reasonable care and is correct to the best knowledge of the company and is published in good faith. The maximum liability of the company under any case shall be the maximum to the total cost of the package charged by the company or the total amount paid to the customer, whatsoever.

Force Majeure:

Neither Econnect Holidays Services Pvt. Ltd. nor any of its parents, subsidiaries, affiliates, officers, directors, employees, agents, or suppliers and their respective successors, heirs, and permitted assigns shall be responsible for or be deemed to be in default on account of, any failure to perform or due to delay in performance of any of its obligations hereunder, in whole or in part, if such performance is rendered impracticable by the occurrence of acts of war, whether declared or undeclared, sabotage, embargo, acts of terrorism, riot or other civil commotion, failure in transportation, the act of any government or any court or administrative agency thereof, acts of God, fire, explosion, flood, earthquake, strike, the act of government or other catastrophes, epidemics or quarantine restrictions, or other cause(s) beyond the reasonable control of Econnect Holidays Services Pvt. Ltd. (“Force Majeure”). Both you and Econnect Holidays Services Pvt. Ltd. shall use their best efforts to avoid, overcome and offset the effects of any cause or potential cause of an event of Force Majeure. Upon cessation of the cause of the Force Majeure, the Terms of Use given hereunder shall again become fully operative. However, a Force Majeure event will not relieve you or Econnect Holidays Services Pvt. Ltd. of the obligations accrued prior to the occurrence of the Force Majeure.

Force Majeure:

Although Company makes all efforts to ensure an enjoyable and trouble-free tour, occasionally plans may go wrong. Should you have any complaint, please report the issue to Company’s Travel Manager at the time who will take all necessary steps possible to resolve the matter immediately. Any disputes between clients and Econnect Holidays Services Pvt. Ltd. Shall be governed by the Jurisdiction of New Delhi, India as per law of the land.

Privacy:

Your privacy is extremely important to us. Upon acceptance of these Terms of Use, you confirm that you have read, understood, and unequivocally accepted our Privacy Policy.

Booking:

Your contract/Booking is with “Econnect Holidays Services Pvt. Ltd.”. This contract comes into force when a tour of your choice is confirmed by the “Econnect Holidays Services Pvt. Ltd.” and it has received your booking along with the booking/advance amount deposit. The traveller is required to furnish all details needed as per the booking form and its relevant section must be correctly and fully completed.

TOUR CANCELLATION / NO SHOW / EARLY DEPARTURE:

In case of cancellation of tour/travel services due to any avoidable/unavoidable reason/s, we must be informed in writing. Cancellation charges would be effective from the date we receive the letter in writing and cancellation charges would be as follows except during peak season:

Note: Above cancellation policy will not be applicable for Train and Flight ticket booking which is as per the airline and railways policy.

Cancellation charges for Flight Ticket booking only:

Actual Cancelation charges as per Airlines + 50 Rs service charges by Econnect Holidays Services Pvt. Ltd. Also above cancellation policy may differ depending on the effective cancellation policy applicable by the various supplier and the final cancellation policy would be communicated at the time of making the final booking.

Mode of Refund

You acknowledge and understand that refund may be made in the form of a credit note/ voucher such that it may be used for future travel subject to terms applicable thereon or may be done in cash. In all cases, the mode of refund (credit note or cash) is dependent upon the Travel Agent and/ or Service Provider as the case may be.

Indemnification & Restrictions On Refund:

The Customer agrees to indemnify, defend and hold harmless Econnect Holidays Services Pvt. Ltd., its affiliates, and their respective officers, directors, lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs, and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by such indemnified persons, that arise out of, result from, or may be payable by virtue of, any breach of any representation or warranty provided by the User, or non-adherence of any covenant by the Customer.
Econnect Holidays Services Pvt. Ltd. reserves its right to hold or forfeit the refund if it found the Customer violating any of the T&Cs.

Customer's Responsibility:

While we appreciate hearing from you, however, you are fully responsible for the content of your Submissions, (specifically including, but not limited to, reviews posted about this Website and/or about Econnect Holidays Services Pvt. Ltd. on any other website, Social Media Platform or any other mode as may be available to you from time to time). You will not post or continue to post or transmit or continue to transmit or publish/ continue to publish any content about Econnect Holidays Services Pvt. Ltd. and/ or any of its subsidiaries or affiliates which is unlawful, threatening, libelous, defamatory, untrue, obscene, pornographic or other material or content that you believe or have reasons to believe to be untrue and may have an adverse impact on the reputation of Econnect Holidays Services Pvt. Ltd..

PASSPORTS & VISAS:

To travel to Neighbouring countries from India you would need 06 months valid passport and for certain countries, visa will require. And processing of Passport and Visa are not included in the tour cost.

HEALTH:

The Traveller acknowledges that Overseas Trips may involve considerable physical exertion including walking for long distances or long waiting periods or other physical activities of like nature which are beyond the control of the Company.
The Traveller undertakes that he/she is physically fit to undertake the above-said activities and also that he/she does not suffer from any medical issues or infirmity preventing him/her from undertaking the requisite physical activities.
The company reserves the right to request the Traveller a medical certificate providing for his/her physical fitness for the Overseas Trip. This may include requirements for immunization or vaccination as specified by the Embassy or the Consulate of the country/countries to which the Overseas Trip is being scheduled.
Traveler acknowledges that it is mandatory to purchase overseas medical insurance policy and other appropriate travel insurance policies, at his/her own cost, to cover the risk for life and his/her property during the period of Overseas Trip on his/her own. Traveler acknowledges that Company shall not be responsible and liable for any theft, damages, bodily injury, and loss of life, whatsoever. Company shall make best endeavors to assist the Traveller during medical emergencies and facilitate the return of the Traveller to his/her home country. However, Company shall not be in any way responsible for any loss of life or property in any manner, whatsoever. The company shall not further entertain any refund claim for the pending duration of the Overseas Trip which could not be continued due to medical reasons.
The Trip/tour Quote does not include the cost of insurance premiums towards insurance policies. Accordingly, Traveller is strongly advised to purchase the appropriate medical insurance policies.

EARLY CHECK-IN / LATE CHECK-OUT:

Please note that the standard check-in / Checkout times in most of the hotels are 1400 Hrs. to 1300 Hrs (IST). Therefore, the cost of Early check-in or Late check-out is not included in the tour cost. The company can always make a request for early check-in or Late checkout if required but without any guarantee and that entirely depends upon the policy of the hotel, time of the year, and availability of the room.

EXTRA USES OF OUR VEHICLE:

Please note that the cost of the vehicle (car/coaches with the driver) is not included in the tour cost like - Usage of the vehicle after transfer or after sightseeing until or unless it is mentioned in the itinerary.

RIGHTS TO AMEND THE ITINERARY IF REQUIRED:

Tour once commenced will strictly go as per the finalized itinerary. In case of events and circumstances beyond control, Company reserves the right to change all or any parts of the contents of the itinerary for the safety and well-being of its guests/passengers.

SURCHARGE:

The Price of your travel arrangement is subject to surcharges in case of a sudden hike in fuel prices, scheduled airfare, and any taxes levied by the government. Even in this case, Company will try to absorb an amount of 2%, and an amount exceeding over 2% will be surcharged.

GENERAL TERMS AND CONDITIONS:

Econnect Holidays Services Pvt. Ltd. reserves the right, at any time, without prior notice and liability and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether. Econnect Holidays Services Pvt. Ltd. shall be the sole authority for the interpretation of these terms.
Econnect Holidays Services Pvt. Ltd. shall not be liable for any loss or damage arising due to force majeure events.
In the event of any misuse or abuse of the offer by the Customer or travel, Econnect Holidays Services Pvt. Ltd. reserves the right to deny the offer or cancel the booking at its sole discretion. Econnect Holidays Services Pvt. Ltd. shall not be liable for any indirect, punitive, agent special, incidental or consequential damages arising out of or in connection with the offer. “The above terms and conditions shall be part and parcel of the User Agreement”
